COVENANTS

To find the covenants for your property, use this map to identify your section within Ormond Subdivision. Once you have identified the name of your section, click on the corresponding button below to access covenants. Within some sections there are further divisions of covenants. Some are organized by Lot # while others are by street names. Be sure to look at all documents within each section to assure you are accessing the correct covenants. Ormond Covenant Restriction Violation Procedures

The Ormond Development Company developed the covenants to provide the residents with a consistent set of rules to allow the Ormond Community to help keep our community a nice place to live. They are also controls to provide all residents with a set of rules to allow for continuity and property values to maintain fair their market price.

In order to conduct and review neighborhood covenant violations in a fair and orderly manner, there are rules that Ormond Civic Association Board need to follow. The following procedures should be followed when addressing a violation to the Ormond Restrictive Covenants:

Complaint- address the complainant, field concerns and gather specific information

Investigate – conduct further research by reviewing the issue, review the respective subdivision, resident address and associated restrictive covenants for the reported violation.

· Gather photographs

· Review Google Earth timeline aerials

· Copy covenant related to the violation

· Review applicable codes

· Review zoning

Notify – communicate the violation of an Ormond Restrictive Covenants or regulation.

· Hand deliver/mail Initial Violation Notice

· Mail Second Violation Notice

· Certified Mail Final Violation Notice

Hearing – If the homeowner/resident does not correct the violation after the final notification, meet to discuss and determine the next course of action.

Enforcement – If not corrected, the following may ensue:

· The OCA may recommend that the complaint take legal action

· If the Issue is a code or zoning violation, then the issue will be reported to the St. Charles Government Authorities

Most Common Violation Items

Some of the most common violations of restriction covenants are as follows:

· New home construction without proper architectural plan reviews by the OCA

· Modification or renovations to existing residences

· Exterior appearances of existing residences

· Improper signage

· Fence Locations, Heights and types

· Swimming Pools/Pool Enclosures

· Lack of maintenance to the exterior appearance of residence or ancillary buildings

· Accumulation of garbage, broken cars, trailers

· Improper parking of recreational vehicle, camper trailers, boats, etc.

· Air B&B/VBRO rentals -Parking /Noise issues

· Lack of vegetation and yard/lot landscaping maintenance

Items to Remember When Addressing a Violation

When it comes to enforcing those rules, things can get tricky. These items should be thought of during the complaint process:

· Homeowners/residents don’t want to feel like they are being ridiculed for their choices. People have differing ideas on how the property they own should be managed.

· Make sure the covenants are posted verbatim and clear.

· State the facts

· Provide evidence if possible

· Be concise

· Be consistent.

· Stick to the process
